New Member Policies
1 Selection Process
1.1 All applications for Membership of The Wingerworth Allotment Cooperative Society Ltd shall be made via the online form, email or hardcopy, to the Secretary of the Society. The Secretary shall maintain records of a waiting list.
1.2 To be a plot holder you must live within the Electoral Parish of Wingerworth. See the map below.
3 Forfeiture of Tenancy, a Notice to Quit, (Involuntary Termination)
3.1 The Management committee shall monitor the new plot holders progress, offer advice if necessary and seek to resolve any emerging concerns in an informal, constructive and amicable manner. However, should the Management Committee have ongoing concerns about the plot holder’s ability to maintain the plot in accordance with the terms of their Sub-Tenancy Agreement and the informal remedies and first formal letter prove ineffective then by simple majority vote at a committee meeting has the right to issue a Notice to Quit/Forfeiture the Sub-Tenancy Agreement with a 28 days notice. This would include any associate member named on the Sub-Tenancy signed agreement
3.2 Upon a Notice to Quit,/Forfeiture of the Sub-Tenancy being served the new member plot holder shall agree a time and date by which to remove from the Allotment site all personally owned crops, possessions, debris, building or other constructions leaving their plot in a state ready for immediate possession by an incoming new member or existing member. If you do not want or are unable to remove items, you should notify the Secretary and make alternative arrangements.
All appeals will be fairly heard and assessed at a Committee Meeting. The outcome will be decided by a simple majority vote.

1.5 When a plot becomes available, the proposed new plot holder(s)/Associate Member will meet with a member of the management committee .
Once agreed, a vacant plot is allocated to the individual/s who should complete a registration form to join the Society, payment of the Society's membership subscription and share fee, the payment of plot rental fee and a one -off bond fee. It is a requirement to be a fully paid up member of the Society to rent a plot. All new members will be offered a sub-tenancy on or after the 31st March of each year.
- '1.3 The Management Committee has the right to refuse and reject an application for a good and sufficient reason.
- '6.2.1 Membership shall be open to such persons as may be admitted by the Management Committee from time to time.
- 6.2.2 The Management Committee shall have the right to, for good and sufficient reason, reject an application for membership.

Each application will be processed in chronological order of written
receipt according to their initial request. Should
an applicant currently on the
Society’s waiting list is offered they will have one calendar week to either accept
or decline the offer.
1.7 Should the individual decline the plot then they shall be moved to the bottom of the waiting list. In this event the plot will be offered in to the applicant or existing member on the waiting list and the same process will apply.

2 Surrender of the Tenancy: a Voluntary Termination
2.1
Should a Sub-Tenant wish to terminate, Surrender their Sub-Tenancy
Agreement they may do so in writing at any time. This
notification
should
be made to the Secretary.
2.2 The sub-Tenant should sign the Surrender Form and return this to the Secretary. Any arrangements regarding the clearance of the plot must be agreed with the Secretary.
2.3 Upon notice of the Surrender of the Sub-Tenancy, member shall have an agreed time and date by which to remove from the Allotment Gardens all personally owned crops, possessions, debris, building or other constructions leaving the plot in a state ready for immediate possession by an incoming plot holder(s). 4 Right of Appeal:
Should a Notice to Quit (Forfeiture of the sub-tenure) be invoked then the New member has the right of appeal. Should the member/'s wish to exercise this right then they shall write to the Secretary within seven calendar days of notice being served clearly setting out the grounds for appeal.

4.1 There are three options for the committee to consider:
• Uphold and enforce the 'Notice to Quit'/Forfeiture of Sub-Tenancy.
• Re-instate the plot holder with an additional probationary period of 3 months, where any further breach of the Allotment Terms and
Conditions will result in immediate revocation with no right of appeal.
• Re-instate the plot holder with no probation.
4.2 The appeal hearing will be minuted and circulated to both the member/'s and the committee to ensure there is a record of the process.
4.3 The decision of the committee is final.
4.4 If a probationary period is agreed on, a review/inspection will be held and a decision will be made by the committee as to whether the conditions of the probationary period have been met. If there are no issues, the tenant will remain on the plot. If there are further breaches of the conditions of probationary or Sub-Tenancy agreement, the committee have a right to immediately revoke the sub- tenancy with no further right of appeal.
New plot holders
Under the terms of our lease with the Parish Council, clause 1b states the residential eligibility criterion.
Under
Section 23(1) of the 1908 Allotments Act, the Council has a duty to
provide “sufficient allotments where they consider that there is
a demand for them in their area”; the Tenant shall prioritise the
allocation of plots to residents living within the electoral parish
of Wingerworth (plot holders should be Wingerworth residents at the
point of taking on the plot, in line with the 12 month renewal of
agreements if the plot holder is no longer a resident of
Wingerworth the agreement to cease at the end of the current
agreement period) as delineated on the plan in Appendix B (Local
Government Boundary Commission for England – Electoral Review of
North East Derbyshire)
hereto and therein edged in BLUE and denoted as Adlington, Hardwick
Wood, Longedge, Wingerworth and Woodthorpe Civil Parish Wards
(hereinafter called “the Parish”).
